    s. 8 Recognition and equality before the law A rough sleeper is often subject to stigmatisation and marginalisation, potentially leading to discrimination or unequal treatment in accessing essential services or public spaces, undermining their right to equal protection of the law and the enjoyment of their human rights without discrimination.
    s. 9 Right to life Sleeping rough and exposed to the elements, often with deteriorating health conditions, poses known and immediate risks to a rough sleeper's life. Public authorities have a duty to take reasonable steps to protect life from such risks, especially for vulnerable individuals.
    s. 10 Protection from cruel, inhuman or degrading treatment Prolonged homelessness, living in unsanitary conditions, and enduring extreme weather without adequate shelter or support can constitute inhuman or degrading treatment, particularly when there is a lack of effective intervention over an extended period.
    s. 12 Freedom of movement A rough sleeper is deprived of the freedom to choose where to live due to a lack of available and affordable housing. Being compelled to move on from public spaces without alternative accommodation can further restrict this right.
    s. 13 Privacy and reputation Living in public spaces inherently strips a rough sleeper of personal privacy and dignity, as their daily activities are exposed. Their lack of a private 'home' constitutes an arbitrary interference with their privacy.
    s. 17 Protection of families and children Where a rough sleeper has family connections, prolonged homelessness may result in family separation or undermine family unity. The State has a duty to protect the family unit, and failure to provide adequate housing support may compromise this protection.
    s. 21 Right to liberty and security of person The absence of a secure place to live and the constant exposure to risks in public spaces compromise a rough sleeper's physical safety and personal security. Public entities ought to take reasonable steps to ensure the physical safety of people in known danger of harm.
    s. 38 Conduct of public authorities Public authorities (e.g., state government departments, local councils) are obliged to act compatibly with human rights and give proper consideration to these rights when making decisions or taking actions that affect rough sleepers, including policies on housing, social services, and public space management.
